- WAIVER OF LIABILITY: I, on behalf of myself, my children, my spouse/partner, and any caregivers or guests that attend with my children, hereby voluntarily release, forever discharge, and covenant not to sue Midland Music Makers, Jacqueline Cote, Elite Ballroom Dance Academy, Music Together® LLC, and these companies' owners, managers, contractors, members, employees, agents, and volunteers (“Released Parties”) for any claims that may arise out of or relate in any way to my or my child’s exposure to any communicable disease, including but not limited to the novel coronavirus or COVID-19. I release, indemnify and agree to hold harmless Midland Music Makers, Jacqueline Cote, Elite Ballroom Dance Academy, Music Together® LLC, and their respective directors, officers, employees, sponsors, teachers, and staff from any claim, suit, demand, or action arising in connection with mine or my child’s participation in programs operated at Midland Music Makers.

-Payment Plans: I agree to make payments per the schedule that Jacqueline Cote agreed to. I understand that I cannot attend a class that has not been paid for. I understand that I must pay for a class even if my family is absent for any reason.

- Photo/Video Release: By signing up for a class at Midland Music Makers, I understand and accept that on occasion, a photo or a video may be taken of myself or my family to be used by Midland Music Makers for the purpose of marketing the program. If this is not acceptable for your family, please contact us via email at [email protected]. I understand that if I do not want my child’s photo used for marketing, it is my responsibility to let Jacqueline Cote know.

- Class Availability: All classes are subject to minimum and maximum enrollment requirements. Classes may be combined or split into two and class times may be altered to suit enrollment.  

- Weather/Class Cancellation: In the event of inclement weather or teacher absence you will be texted and emailed the morning of class at the latest and there will be an announcement in the Private Facebook group. Please respond to the text, email or FB post to let us know you are aware of the cancellation. In the event of inclement weather we reserve the right to cancel class.  We will apply the cancelled class date to the end of the semester, with a max of 2 classes.

- Refunds/Credits: Refunds are provided only if the class you have paid for is cancelled and you cannot attend an alternate class, or after the first week of class. There are no refunds/credits for natural disasters, community crisis, or circumstances beyond our control. 

- Illness: Any children and any adults who may have a contagious illness, runny nose, cough, sneezing, fever, etc, may not attend class. We offer unlimited makeups for Music Together classes in order to provide as much flexibility for your family as possible. Thank you for keeping our community healthy. We have many tiny babies and pregnant mommies at Midland Music Makers and we work hard to protect everyone. Safety is our number one priority!

- Make Ups/Absences: Makeup opportunities are based on availability. You MUST schedule in advance using the Makeup Scheduler and we ask you to mark any absences planned or unplanned in the portal to open your spot to other families. You may rollover unused makeups toward the following semester only if you are registered for the following semester. (ie make-ups cannot be carried over to mini sessions or special events)  

- Props: Many kiddos explore props by putting them in their mouths, you can be comfortable letting them explore our props as we will be disinfecting with food safe Seventh Generation wipes between classes. We will have WET BINS in the classroom for parents to put certain props in after being tasted.

- Food/Drink: Food and drink are not allowed in the classroom/studio. Please be sure to clean up after your child in the lobby.

- Credits on Accounts/Gift Certificates:  Credits from Music Together Classes or Referrals may not be used on special events. Gift Certificates may only be used for Music Together semester classes. Gift Certificates are not accepted for special events, holiday classes, or birthday parties.

- Siblings and Extended Family Members: Siblings must have their own registration to attend classes, ie they cannot attend a siblings class or use a sibling make-up. We understand that life happens sometimes, and we will make exceptions on an individual basis. However in the event that this gets to be habitual, Midland Music Makers has the right to deny additional guests, or mandate that a sibling register for the class. Extended Family Members must have their OWN account and registration even if they are attending class with you, ie they cannot be added as sibling.  

 

We reserve the right to modify or change our offerings and terms of service at any time without notice. 

 

I HAVE CAREFULLY READ THIS WAIVER AND POLICIES OF MIDLAND MUSIC MAKERS AND FULLY UNDERSTAND ITS CONTENTS. BY ENROLLING IN CLASSES AT MIDLAND MUSIC MAKERS MUSIC TOGETHER®, I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.
